The terms and conditions governing your use of the Kalluu platform.

1. Acceptance of Terms

By accessing or using Kalluu ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to all the terms, you may not access or use the Platform. These Terms apply to all visitors, users, and others who access or use the Platform.

2. Eligibility

You must be at least 13 years of age to use the Platform. By agreeing to these Terms, you represent and warrant that you are at least 13 years old. If you are using the Platform on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms. Accounts registered by bots or automated methods are not permitted.

3. Account Registration

When you create an account, you must provide accurate, complete, and current information. You are solely responsible for safeguarding your password and for any activities or actions under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. User Conduct

You agree not to use the Platform for any unlawful purpose or in violation of these Terms. Prohibited activities include: (a) Harassing, threatening, or intimidating other users; (b) Posting content that is defamatory, obscene, or discriminatory; (c) Impersonating any person or entity; (d) Interfering with the operation of the Platform; (e) Attempting to gain unauthorized access to any part of the Platform; (f) Using the Platform for spam or unsolicited communications; (g) Engaging in any activity that could damage, disable, or impair the Platform.

5. Intellectual Property

The Platform and its original content, features, and functionality are owned by Kalluu and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You retain ownership of any content you submit, post, or display on the Platform, and you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with the Platform.

6. Termination

We may terminate or suspend your account at any time, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform or contact support for account deletion. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. Kalluu makes no representations or warranties of any kind, express or implied, regarding the operation or availability of the Platform. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses.

8. Limitation of Liability

In no event shall Kalluu be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform. Our total liability for any claims under these Terms shall not exceed the amount you have paid us in the past 12 months. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above exclusions may not apply to you.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Delaware. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last Updated" date. By continuing to access or use the Platform after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Platform.
